ABSTRACT

This article aims to study the applicability of the constitutional principle of contradiction in the context of the police investigation and the understanding of their legal nature. Therefore, it is necessary to make some notes on the general theory of evidence and quality that they should be produced during the investigation stage of criminal proceedings because they serve as the basis for developing fair and effective future prosecution, seeking thus the justice in the decision and legal certainty.
