In 2026, the Brazilian Arbitration Law celebrates its thirtieth anniversary. Few pieces of legislation have transformed the way Brazil resolves disputes so profoundly, which is why this milestone deserves both recognition and reflection. Before 1996, arbitration had limited use in the country. The arbitration clause did not fully bind the parties, the arbitral award was subject to judicial approval, and enforcement faced obstacles that undermined the practical usefulness of the institution. Law No. 9,307/1996 changed this scenario. It granted binding force to arbitration agreements, placed arbitral awards on an equal footing with judicial judgments, and eliminated the requirement for approval by the Judiciary. As a result, arbitration became an effective means of dispute resolution. Thirty years on, arbitration is a well-established institution that calls for careful study of its points of interaction with other areas of law, particularly civil procedure. Hence the subtitle of this book, which brings together reflections on the path taken so far and perspectives on what is yet to come.
